GILLETTE, WY – The Board of Trustees of the Campbell County Hospital
District has chosen to inform the public regarding former Trustee George
Dunlap’s removal from the Board and subsequent appeal from the Board’s
Final Determination on Trustee’s Ethical Violations leading to Mr.
Dunlap’s removal from the Board. The Campbell County Health Board
of Trustees received Former Trustee Mr. Dunlap’s Brief on October 26, 2018.
The Board of Trustees feels it is appropriate to advise the public of the
status of the ongoing litigation.
On July 2, 2018, Former Trustee George Dunlap petitioned for judicial review
of the administrative action stemming from the Campbell County Hospital
District Board of Trustees contested case hearing in which a final determination
was to remove Trustee Dunlap from the Board. Mr. Dunlap was removed from
the Board for conspiring with opposing counsel in an ongoing litigation
against Campbell County Hospital District, in which he disclosed confidential
information that was discussed during executive session. It was determined
Mr. Dunlap’s disclosures were a direct violation of Wyoming Statute
9-13-105 of the Government Ethics and Disclosure Act. Additionally, these
actions constituted a violation of Mr. Dunlap’s acknowledgement
of fiduciary duties and confidentiality of board members of Campbell County
Hospital District. Mr. Dunlap’s actions further violate the Campbell
County Hospital District Board’s Conduct and Ethics governing policies
and procedures and are a violation of the Conflict of Interest Policy.
Former Trustee Dunlap’s decision to appeal the Board’s Final
Determination on Trustee’s Ethical Violations has required the Board
to incur further legal expenses in defending the appeal. Former Trustee
Dunlap has further requested the District Court of Campbell County to
remand the case back to the Campbell County Hospital District administrative
process, all of which would require additional costs and will become moot
pending the outcome of the election on November 6, 2018.
